AN ACT
To amend chapter 192, RSMo, relating to the department of health by adding thereto one new section relating to hepatitis A exposure.
Section A. Chapter 192, RSMo, is amended by adding thereto one new section, to be known as section 192.905, to read as follows:
192.905. 1. Any establishment described in section 196.190, RSMo, with an employee who has contracted hepatitis A in which the public is at risk of exposure shall be liable for up to twenty thousand dollars of the cost of treatment of other employees or patrons of the establishment who are treated through the department of health or a local public health agency as a result of their exposure to hepatitis A.
2. An establishment shall not be liable pursuant to subsection 1 of this section if the establishment:
(1) Has implemented safe food handling practices as required by the department of health's Missouri food code; and
(2) Voluntarily requires all employees of the establishment to be immunized for hepatitis A as a condition of
employment; except that, any employee of the establishment may refuse immunization for hepatitis A by executing
a written refusal stating the employee's religious, philosophical or medical reason for refusal. The establishment
shall maintain a record of all written refusals executed by their employees.
