AN ACT

To amend chapter 313, RSMo, relating to licensed gaming activities by adding thereto one new section relating to contributions by gaming interests, with penalty provisions.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 313, RSMo, is amended by adding thereto one new section, to be known as section 313.900, to read as follows:

313.900. 1. It is unlawful for any person, firm, corporation, partnership or association or the spouse, officer, director, trustee, partner or senior management level employee of any person, firm, corporation, partnership or association who holds a license or permit to operate a gaming or gambling enterprise, or if an applicant therefor, to, directly or indirectly, contributes any money or other thing of value to any candidate for nomination or election to any public office in this state, or to any committee of a political party, or to any group organized in support of any such candidate or political party, including contributions to political action committees.

2. It is unlawful for any candidate, political action committee or other person to accept or receive any contribution knowing that it is prohibited by this section.

3. Any person, corporation or any other entity who violates the provisions of subsection 1 of this section is guilty of a class C felony and such violation shall, also, be grounds for the revocation or denial of any license issued by the gaming commission. Any person or committee who violates the provisions of subsection 2 of this section is guilty of a class C felony and shall, also, forfeit such contributions received in violation of subsection 2 of this section over to the state to be deposited in the general revenue fund.

4. The provisions of this section shall not prohibit an expenditure by a candidate for his or her own campaign or a contribution, loan or transfer of funds by a candidate to his or her own political committee.
