AN ACT

To repeal section 331.010, RSMo Supp. 1999, relating to chiropractors, and to enact in lieu thereof one new section relating to the same subject.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Section 331.010, RSMo Supp. 1999, is repealed and one new section enacted in lieu thereof, to be known as section 331.010, to read as follows:

331.010. 1. The "practice of chiropractic" is defined as the science [and], art and philosophy of examination, diagnosis[, adjustment, manipulation] and treatment of [malpositioned articulations and structures of the body, both in inpatient and outpatient settings] human ailments. Chiropractic treatment recognizes the innate recuperative powers of the body and considers each person an integrated being. Chiropractic treatment shall be directed towards restoring and maintaining the normal health and function of the human body. The practice of chiropractic includes the adjustment, manipulation, treatment, management and prevention of malpositioned articulations and structures of the body and the vertebral subluxation complex, both in inpatient and outpatient settings. Chiropractors or chiropractic physicians may advise and instruct patients on all matters pertaining to hygiene and nutrition. [The adjustment, manipulation, or treatment shall be directed toward restoring and maintaining the normal neuromuscular and musculoskeletal function and health. It] The practice of chiropractic shall not include the practice of medicine, [use of] operative surgery, obstetrics, osteopathy, podiatry, nor the administration or prescribing of any [drug or medicine nor the practice of medicine. The practice of chiropractic is declared not to be the practice of medicine and operative surgery or osteopathy within the meaning of chapter 334, RSMo, and not subject to the provisions of the chapter] controlled substances, legend drugs or other restricted drugs behind the counter that must be requested from a pharmacist.

2. A licensed chiropractor may practice chiropractic as defined in subsection 1 of this section by [those] any of the following methods [commonly taught in any chiropractic college recognized and approved by the board]:

(1) Those generally accepted within the health care community;

(2) Those taught by chiropractic colleges accredited by the council on chiropractic education;

(3) Those taught in postgraduate study; or

(4) Those taught in course work approved by the Missouri State Board of Chiropractic Examiners.

[3. Chiropractors may advise and instruct patients in all matters pertaining to hygiene, nutrition, and sanitary measures as taught in any chiropractic college recognized and approved by the board.]
