AN ACT
To amend chapter 301, RSMo, relating to the registration and licensing of motor vehicles by adding thereto one new section relating to a Missouri D.A.R.E. Officers' Association.
Section A. Chapter 301, RSMo, is amended by adding thereto one new section, to be known as section 301.3061, to read as follows:
301.3061. 1. Any person may receive special license plates as prescribed in this section after an annual payment of an emblem-use authorization fee to the Missouri Drug Abuse Resistance Education (D.A.R.E.) Officers' Association. The Missouri D.A.R.E. Officers' Association hereby authorizes the use of its official emblem to be affixed on multiyear personalized license plates as provided in this section.
2. Any contribution to the Missouri D.A.R.E. Officers' Association derived from this section, except reasonable administrative costs, shall be used solely for the purpose of promoting and supporting the objectives of the Missouri D.A.R.E. Officers' Association. Any person may annually apply for the use of the emblem.
3. Upon annual application and payment of a twenty-five-dollar emblem-use contribution to the Missouri D.A.R.E. Officers' Association, the association shall issue to
the vehicle owner, without further charter, an emblem-use authorization statement, which shall be presented by the person to the director of the department of revenue at the time of registration of a motor vehicle.
4. Upon presentation of the annual statement and payment of the fee required for personalized license plates in section 301.144, RSMo, and other fees and documents which may be required by law, the director shall issue a personalized license plate, which shall bear the emblem of the Missouri D.A.R.E. Officers' Association in a form prescribed by the director to the vehicle owner. Such license plates shall be made with fully reflective material with a common color scheme and design, shall be clearly visible at night, and shall be aesthetically attractive, as prescribed by section 301.130, RSMo.
5. A vehicle owner, who was previously issued a plate with the Missouri D.A.R.E. Officers' Association's emblem authorized by this section, but who does not provide an emblem-use authorization statement at a subsequent time of registration, shall be issued a new plate which does not bear the Missouri D.A.R.E. Officers' Association's emblem, as otherwise provided by law.
6. The director of the department of revenue shall promulgate rules and regulations for the administration of this
section. No rule or portion of a rule promulgated pursuant to the authority of this section shall become effective
unless it has been promulgated pursuant to the provisions of chapter 536, RSMo.
