AN ACT
To amend chapter 196, RSMo, by adding thereto one new section relating to the tobacco settlement money, with a contingent effective date.
Section A. Chapter 196, RSMo, is amended by adding thereto one new section, to be known as section 196.1015, to read as follows:
196.1015. 1. Any moneys received by the state pursuant to the master settlement agreement entered into on November 23, 1998, by the state and leading United States tobacco product manufacturers shall be disbursed by the department of revenue to each county in this state based on population as determined by the 2000 census. Three percent of such moneys received may be retained by the county for reimbursement of administrative costs.
2. Each county shall elect a five-member board to appropriate the moneys received pursuant to subsection 1 of this section. Each member of the board shall be elected for a four-year term, except that of the initial members of the board two shall be elected to a term of four years, two shall be elected to a term of three years and one shall be elected for a term of one year. The members of the board shall receive no compensation as members of the board, but shall be reimbursed for their actual and necessary expenses incurred in the performance of their duties as members of the board from the moneys received for reimbursement of administrative costs pursuant to subsection 1 of this section.
3. The board shall utilize the moneys received through the issuance of grants as follows:
(1) Primarily for antismoking, drug and alcohol campaigns targeted to children; and
(2) Secondarily to assist hospitals, health clinics, health care agencies, school districts, individual physicians, MRDD families with respite, Special Olympics and senior citizens.
The board shall provide application forms for any person or entity applying for a grant pursuant to this section.
Section B. The provisions of section A of this act shall become effective upon the passage of a constitutional amendment
which authorizes the disbursement of any tobacco settlement moneys received by the state.
