AN ACT

To amend chapter 643, RSMo, by adding thereto one new section relating to motor vehicle emissions inspections, with an emergency clause.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 643, RSMo, is amended by adding thereto one new section, to be known as section 643.365, to read as follows:

643.365. The commission may temporarily suspend the operation of any motor vehicle emissions inspection program established pursuant to sections 643.300 to 643.360 upon determining that operational failures or problems exist which would cause substantial inconvenience to motor vehicle owners if the program were to continue operation without revisions to one or more elements of the program. Such suspension shall become effective no later than thirty days following such determination. During any such suspension, no motor vehicle registration of a vehicle otherwise required to be inspected and approved pursuant to sections 643.300 to 643.360 shall be denied on the basis of failure to have the vehicle inspected and approved pursuant to sections 643.300 to 643.360.

Section B. Because of the need to provide vehicle emissions inspections in a timely manner, section 643.365 of this act is deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and section 643.365 of this act shall be in full force and effect upon its passage and approval.
