AN ACT

To amend chapter 105, RSMo, relating to public officers and employees by adding thereto one new section relating to lobbying of the general assembly by state agencies, with penalty provisions.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 105, RSMo, is amended by adding thereto one new section, to be known as section 105.465, to read as follows:

105.465. No moneys appropriated by the general assembly shall, unless otherwise authorized by law, be used directly or indirectly to pay for any personal service, advertisement, telegram, telephone, electronic mail, letter, printed or written matter or other device intended or designed to influence in any manner any member of the general assembly to favor or oppose, by vote or otherwise, any legislation or appropriation by the general assembly, whether before or after the introduction of any bill or resolution proposing such legislation or appropriation. This section shall not prevent officers or employees of this state, or of any agency or department of this state, from communicating with members of the general assembly on the request of any member of the general assembly, or from communicating to the general assembly, through the proper official channels, requests for legislation or appropriations which they deem necessary for the efficient conduct of the public business. Any officer or employee of this state or of any department or agency of this state who violates or attempts to violate this section shall be guilty of a class A misdemeanor and shall be, subject to the appropriate procedures for removal, removed from office or employment.
