JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment to article X of the Constitution of Missouri, relating to taxation by adding thereto one new section relating to the same subject.




Be it resolved by the House of Representatives, the Senate concurring therein:

That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2000, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article X of the Constitution of the state of Missouri:

Section A. Article X, Constitution of Missouri, is amended by adding thereto one new section, to be known as section 25, to read as follows:

Section 25. Any moneys received by the state of Missouri as a result of a tobacco settlement agreement shall be deposited in a special trust fund to be known as the "Tobacco Settlement Trust Fund". The moneys in the fund and all earnings resulting from the investment of such moneys shall be subject to appropriation as follows:

(1) No more than ten percent of the moneys for antismoking programs, with the remainder of the moneys used to retire state debt incurred prior to the effective date of this section; and

(2) Upon complete retirement of state debt in accordance with subdivision (1) of this section:

(a) Sixty percent of the moneys shall be refunded annually to the people of the state of Missouri as if such moneys were excess total state revenues pursuant to section 18 of this article;

(b) No more than ten percent of the moneys for antismoking programs; and

(c) The remainder of the moneys to be deposited into the general revenue fund.
