SS SB 813 -- Discipline of Law Enforcement Officers
This substitute makes changes to the procedure for discipline of certain law enforcement officers.
The substitute requires that certain officers who are dismissed, demoted, or suspended are entitled to a hearing within 7 days upon written request. The employing law enforcement agency is required to provide a written explanatory statement at the hearing. Currently, the agency's explanation may be an oral statement. The substitute also requires the state to reimburse municipalities for any resulting increased costs. Agencies or municipalities already having similar procedures are exempted from the act.
The substitute also clarifies conduct which may result in the disqualification of peace officers. The substitute defines "gross misconduct" as conduct that includes the illegal or unauthorized use of closed or confidential information.
