HB 408 -- CEMETERY PROPERTY

COMMITTEE ACTION: Voted "do pass by consent" by the Committee
on Local Government and Related Matters by a vote of 18 to 0.
This bill allows the conveyance of cemetery property, other than
ground in which human remains have been buried, back to a
county, city, town, or village after 50 years if the grave site
or property is unused or unclaimed. The political subdivision
must give proper notice of proceedings to transfer ownership.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that many cemetery plots are owned
for more than 50 years. The people who own these plots cannot
be found and the cemeteries need the space. The cemetery owner
must try to find the owners and give proper notices.
Testifying for the bill was Representative Kelley.
OPPONENTS: There was no opposition voiced to the committee.
