HB 454 -- GUARDIANS AND CONSERVATORS
SPONSOR: Monaco
COMMITTEE ACTION: Voted "do pass by consent" by the Committee
on Judiciary by a vote of 14 to 0.
Under current law, a spouse who is a guardian or conservator of
a ward is removed from this position upon the dissolution of the
marriage. This bill allows the former spouse to be reappointed
as guardian or conservator.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that the bill is necessary to make
removal of a former spouse as a guardian or conservator a
rebuttable presumption because it may be in the best interest of
the ward for the former spouse to remain as guardian or
conservator.
Testifying for the bill was Representative Monaco.
OPPONENTS: There was no opposition voiced to the committee.
