Summary of the Committee Version of the Bill

HB 63 -- OVERTIME COMPENSATION

SPONSOR:  Reynolds

COMMITTEE ACTION:  Voted "do pass" by the Committee on Labor by
a vote of 10 to 6.

This bill repeals language requiring employees of certain
amusement and recreation businesses to be paid overtime only
when they work in excess of 52 hours in any one-week period.
These employees will be subject to the general requirement that
overtime be paid for hours worked in excess of 40 per week.

FISCAL NOTE:  Cost to State Fair Fee Fund of $0 in FY 2002, $0
to $68,381 in FY 2003, and $0 to $70,091 in FY 2004.

PROPONENTS:  Supporters say that the bill would provide equality
by simply entitling all workers to the same overtime pay after
40 hours, whereas current law singles out the amusement industry
by placing its overtime pay threshold at 52 hours.

Testifying for the bill were Representative Reynolds; and
Missouri AFL-CIO.

OPPONENTS:  Those who oppose the bill say that the bill would
negatively affect the amusement industry and would in fact hurt
some workers who want to work between 40 and 52 hours, since the
industry would be more likely to hire more workers for less
hours, as opposed to paying overtime to employees for working
more than 40 hours.

Testifying against the bill was Six Flags over Mid-America.
