Summary of the House Committee Version of the Bill


SPONSOR:  Westfall (Hoppe)

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee
on Local Government and Related Matters by a vote of 17 to 0.

This substitute requires any deputy or assistant of a county
collector or a treasurer ex officio collector to give bond and
security to the satisfaction of the collector.  The bond for
each individual must not exceed one-half of the amount of the
bond required for the collector.  The premium of the bond must
be paid by the county or city being protected.

The Clay County Commission is also authorized to reduce the
salary of the county commissioners if they employ a county
administrator to handle administrative functions of the
commission.  The commission is also authorized to reduce the
salary of the associate commissioners upon a unanimous vote of
all 3 commissioners.

The substitute also changes the property tax exemption date to
the first day of January for properties that are acquired during
a calendar year by entities with a tax exempt status.

Under current law, each court administrator's or sheriff's deed
issued under the land tax collection law is presumptive
evidence.  After 2 years from the date of recording of the deed,
the presumption is conclusive.  The substitute changes the 2--
year time frame from 2 years from the recording of the deed to 2
years from the court administrator's foreclosure sale.

FISCAL NOTE:  No impact on state funds.

PROPONENTS:  Supporters say that counties are at risk because
they deal with a large tax revenue, and these funds could be

OPPONENTS:  There was no opposition voiced to the committee.
