HB 1003 -- Electric Generating Activities Co-Sponsors: Burton, Hegeman, Mays (50) This bill establishes an income tax credit for building coal-fired electric generating plants fitted with pollution control devices or retrofitting old coal plants with pollution control devices. The tax credit will be administered by the Department of Economic Development, will not exceed $10 million, and will be equal to 50% of the purchase price of the equipment or technology. The credit may be carried back 3 years or forward 5 years and may be sold. The bill also changes the method by which distributable property of electric power and light companies is distributed. All electric generating equipment placed into service on or after January 1, 2003, owned by electric corporations will be assessed by the State Tax Commission and the value distributed as follows: 50% to the county where the generating equipment is sited; and 50% to counties contiguous to that county according to population. The bill also limits the rulemaking authority of the Department of Natural Resources as it pertains to solid waste, hazardous waste, general safety requirements, and water pollution related to coal-fired electric generating plants built on or after August 28, 2001. Rules will be no more strict than any required for federal law. The Department of Economic Development will establish a task force to study and compare the impacts of burning coal to generate electricity with the impacts of burning natural gas for the same purpose. The task force is charged with developing educational materials on environmental issues related to electricity generation, including the benefits and detriments of using natural gas, coal, nuclear energy, and alternative fuels to generate electricity. The Department of Elementary and Secondary Education will disseminate the materials to students. The bill also establishes the Clean Coal Technologies Information Repository within the Division of Energy to serve as a clearinghouse for technical information concerning clean coal technologies.Copyright (c) Missouri House of Representatives
