Summary of the Introduced Bill

HB 104 -- Caregiver Qualifications

This bill makes several changes to the requirements regarding
caregiver qualifications.  In its main provisions, the bill:

(1)  Adds individuals for whom there is a probable cause finding
of child abuse or neglect to the employee disqualification list
maintained by the Division of Aging;

(2)  Adds information from the employee disqualification list
maintained by the Department of Mental Health to the information
contained in the "Family Care Safety Registry and Access Line,"
a registry administered by the Department of Health providing
information on the backgrounds of child care workers and elder
care workers;

(3)  Adds the Department of Mental Health to the departments
(Corrections, Public Safety, and Social Services) required to
collaborate with the Department of Health in comparing and
updating records relating to the backgrounds of child care
workers and elder care workers for inclusion in the Family Care
Safety Registry;

(4)  Allows, until January 1, 2002, elder care providers to
access the Family Care Safety Registry to check the backgrounds
of elder care workers listed in or registered with the Registry,
in lieu of conducting the background checks as required by
existing statute.  Beginning January 1, 2002, elder care
providers required to conduct background checks must access the
Registry in order to satisfy the employee disqualification
requirements specified in existing statute; and

(5)  Renumbers certain statutory provisions in Chapter 660,
RSMo, dealing with employee disqualification lists, criminal
background checks, and in-home services, as sections in a new
chapter, Chapter 187.
