HB 229 -- Statute of Limitations

Co-Sponsors:  Hosmer, Hanaway

This bill modifies the limitations period for filing actions to
recover damages for economic loss, personal injury, property
damage, or wrongful death caused by a defective condition in the
design, planning, or construction of an improvement to real
property.  These actions must be commenced within 10 years of
the date the improvement is substantially completed.  Currently,
these actions must be commenced within 10 years of the date the
improvement is completed.  Under the bill's provisions, an
improvement is substantially completed when it can be occupied
or used in the manner for which it was intended.
