HB 399 -- Condemnation Proceedings

This bill requires public entities acquiring real property
through condemnation to reimburse the property owner for costs
incurred in the land conveyance, including prorated property
taxes, mortgage prepayment penalties, and recording fees.  In
condemnation cases that are ultimately abandoned by the public
entity, or where the jury award exceeds the award of the court--
appointed commissioners by 10% or more, the court may order the
public entity to reimburse the owner for any appraisal,
engineering, or attorney fees.  The court may also award these
costs in any inverse condemnation proceeding in which the
plaintiff prevails.
