AN ACT

To amend chapter 701, RSMo, by adding thereto one new section relating to family restrooms.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 701, RSMo, is amended by adding thereto one new section, to be known as section 701.455, to read as follows:

701.455. 1. Any facility for which construction commences after January 1, 2002, that provides a restroom or restrooms for use by the general public, including, but not limited to, sports stadiums and arenas, auditoriums and assembly halls, and shopping malls, shall provide:

(1) One family restroom for every pair of male and female restrooms which have three or more toilets. Such family restrooms shall comply with all state and federal laws regarding access for the disabled and shall have a privacy latch; and

(2) A privacy latch for every entrance to restrooms which have no more than two toilets. Such restrooms shall comply with all state and federal laws regarding access for the disabled. Such privacy latches shall not be required for any facility that voluntarily provides a family restroom.

2. As used in this section, the following terms mean:

(1) "Family restroom", an area containing one or more toilets and one or more lavatories;

(2) "Lavatory", a bowl or basin used for the purpose of washing the hands and face;

(3) "Toilet", an apparatus consisting of a bowl or a urinal fitted with a flushing device used for the disposal of bodily wastes.

3. Each facility described in subsection 1 of this section constructed or under construction prior to January 1, 2002, shall provide family restrooms or privacy latches for restroom entrances as required in subsection 1 of this section whenever such facility undergoes major structural renovation. For purposes of this subsection, "major structural renovation" means any reconstruction, rehabilitation, addition or other improvement which requires more than fifty percent of the gross floor area of the existing facility to be rebuilt. The provisions of this subsection shall only apply to the portions of the building being renovated and not to the entire building.
