AN ACT
To amend chapter 26, RSMo, by adding thereto one new section relating to the use of state aircraft by the governor.
Section A. Chapter 26, RSMo, is amended by adding thereto one new section, to be known as section 26.230, to read as follows:
26.230. 1. As used in this section, "private business" shall include, but is not limited to, all personal, political or campaign business.
2. The governor may use a private airplane flown by an individual or entity who is not paid for such flight, for the governor's private business, provided that:
(1) The office of administration, division of flight operations, has given safety clearance for gubernatorial flights to the entity or individual owning such airplane. The office of administration shall establish procedures for obtaining such safety clearance. Such clearance may be in the nature of a general clearance for all flights by such individual or entity; and
(2) The flight conditions at the time the airplane prepares for takeoff are within acceptable parameters as established by the office of administration, division of flight operations. The office of administration shall establish takeoff parameters for such flights which may include, but are not limited to, visibility, ceiling, wind conditions or any atmospheric or other conditions normally included in any assessment of the feasibility of airplane takeoff. In the event that flight conditions are not within acceptable parameters at the time of takeoff, the division of flight operations in the office of administration shall, on its own or in conjunction with the Missouri air national guard, make arrangements to make a plane owned by the state and flown by a pilot from either the division of flight operations or the Missouri air national guard, available to the governor at such time.
3. The governor shall reimburse the state for any private business use of the state airplane. The office of administration shall establish procedures for determining the expenses of such private business uses, and the governor shall submit expense reports and reimbursements in the form and the manner determined by the office of administration for such uses.
4. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been
promulgated pursuant to chapter 536, RSMo.
