AN ACT
To amend chapter 273, RSMo, relating to dogs and cats by adding thereto one new section relating to the animal shelter grant fund.
Section A. Chapter 273, RSMo, is amended by adding thereto one new section, to be known as section 273.410, to read as follows:
273.410. 1. For purposes of this section, the following terms mean:
(1) "Department", the department of agriculture;
(2) "Fund", the animal sanctuary grant fund.
2. There is hereby created in the state treasury the "Animal Shelter Grant Fund", which shall consist of money collected pursuant to this section. The fund shall be administered by the department of agriculture.
3. The fund shall be subject to the provisions of section 33.080, RSMo.
4. The state treasurer shall invest moneys in the fund in the same manner as other funds are invested. Interest and moneys earned on such investments shall be credited to the fund.
5. Any person who sells an unneutered dog or cat at retail, in the normal course of business, shall charge and collect a twenty-five dollar fee to be remitted to the department of agriculture to be deposited in the fund.
6. Moneys in the fund shall be used to provide grants to local licensed animal shelters for spaying and neutering programs.
7. The department shall develop guidelines for the awarding of grants pursuant to this section. The department
may adopt rules to implement the provisions of this section. No rule or portion of a rule promulgated pursuant to
the authority of this section shall become effective unless it has been promulgated pursuant to the provisions of
chapter 536, RSMo.
