AN ACT
To amend chapter 376, RSMo, by adding thereto two new sections relating to health care services.
Section A. Chapter 376, RSMo, is amended by adding thereto two new sections, to be known as sections 376.412 and 376.435, to read as follows:
376.412. Every health carrier, as defined in section 376.1350, that offers pharmaceutical coverage shall provide enrollees with a ninety-day supply of medication prescribed for chronic illnesses if such quantity is authorized by a licensed physician. Coverage pursuant to this section shall be subject to the same deductible and co-payment as apply to other prescriptions in the policy, contract or plan.
376.435. 1. If a health care provider receives a payment from a patient, insurance company or any third party for services rendered on an account which has been turned over to a collection entity, the health care provider shall inform such collection entity of the receipt of a payment.
2. Nonpayment for services rendered to a patient by a health care provider shall not be placed on the patient's credit report, if:
(1) An insurance company or other third-party payor, on behalf of the patient, is responsible for the payment of services rendered to the patient by a health care provider; and
(2) The insurance company or third-party payor fails to make the payment for any reason other than a
nonpayment caused by an act of the patient.
