AN ACT

To amend chapters 193 and 451, RSMo, by adding thereto two new sections relating to heirloom birth certificates and marriage licenses.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapters 193 and 451, RSMo, are amended by adding thereto two new sections, to be known as sections 193.137 and 451.153, to read as follows:

193.137. 1. In addition to any other birth certificate issued pursuant to this chapter, the state registrar shall issue, upon request and payment of a fee of twenty-four dollars, a birth certificate representing that the birth of the person named on the certificate is recorded with the state registrar. The fee required pursuant to this subsection shall be in addition to any other fees required for a copy of a birth certificate.

2. The certificate issued pursuant to subsection 1 of this section shall be in a form consistent with the need to protect the integrity of vital records and shall be suitable for display. Such certificate may bear the seal of the state and may be signed by the governor.

3. A certificate issued pursuant to subsection 1 of this section shall have the same status as evidence as an original birth certificate.

4. The twenty-four dollar fee collected pursuant to this section shall be used to pay the actual costs of producing the birth certificate with the remainder deposited in the "Heirloom Birth Certificate Fund" which is hereby created in the state treasury and shall be appropriated by the general assembly for the purposes authorized in sections 453.073, 453.153 and 453.500, RSMo. Notwithstanding the provisions of section 33.080, RSMo, to the contrary, moneys in the fund shall not be credited to the general revenue fund at the end of the biennium.

451.153. 1. In addition to the marriage license issued pursuant to this chapter, the recorder of deeds shall issue, on request and payment of a twenty-four dollar fee, an heirloom marriage license representing the marriage of the persons named on the marriage license that is recorded in the recorder of deeds office.

2. The marriage license issued pursuant to subsection 1 of this section shall be in a form consistent with the need to protect the integrity of vital records and shall be suitable for display. Such license may bear the seal of the state and may be signed by the governor.

3. A license issued pursuant to subsection 1 of this section shall have the same status as evidence as an original marriage license.

4. The twenty-four dollar fee collected pursuant to this section shall be used to pay the actual costs of producing the marriage license with the remainder deposited in the "Heirloom Marriage License Fund" which is hereby created in the state treasury and shall be appropriated by the general assembly to fund the training of foster parents pursuant to section 210.543, RSMo. Notwithstanding the provisions of section 33.080, RSMo, to the contrary, moneys in the fund shall not be credited to the general revenue fund at the end of the biennium.
