AN ACT
To amend chapter 610, RSMo, by adding thereto one new section relating to disclosures to parents of postsecondary education students.
Section A. Chapter 610, RSMo, is amended by adding thereto one new section, to be known as section 610.033, to read as follows:
610.033. In addition to the requirements established pursuant to the federal Family Educational Rights
and Privacy Act, an institution of higher education shall not disclose to a parent or guardian of a student
who is eighteen years of age or older any information regarding a violation of any federal, state or local law
or rule, or any rule or policy of such institution, regardless of whether such information is contained in the
student's education records. The provisions of this section shall not apply if such student is not financially
dependent, as defined in Section 152 of the federal Internal Revenue Code of 1954, or if the records are
requested through subpoena or judicial order. Any student may waive the right granted in this section by
signing a consent form for such disclosures with the institution at which he or she is enrolled at the
beginning of each academic year.
