AN ACT
To amend chapter 565, RSMo, relating to offenses against the person by adding thereto one new section relating to the same subject, with a penalty provision.
Section A. Chapter 565, RSMo, is amended by adding thereto one new section, to be known as section 565.200, to read as follows:
565.200. 1. Any owner or employee of a long-term care facility, as defined in section 660.600, RSMo, who has sexual contact, as defined in section 556.061, RSMo, with a resident of such facility is guilty of a class B misdemeanor. Any person who commits a second or subsequent violation of this section is guilty of a class A misdemeanor.
2. Consent of the victim is no defense to a prosecution under this section.
