AN ACT
To repeal section 302.536, RSMo 2000, relating to payment of court costs and attorney fees by the department of revenue upon successful appeal of a driving while intoxicated offense, and to enact in lieu thereof one new section relating to the same subject.
Section A. Section 302.536, RSMo 2000, is repealed and one new section enacted in lieu thereof, to be known as section 302.536, to read as follows:
302.536. If the judge upholds the department's ruling to suspend or revoke a person's license after a hearing conducted
pursuant to subsection 1 of section 302.535, and the person appeals such ruling, the department shall, subject to annual
appropriation by the general assembly, pay any court costs and attorney fees the person incurs pursuant to such appeal if
the court reverses the department's ruling to suspend or revoke such person's license.
