AN ACT
To amend chapter 165, RSMo, by adding thereto one new section relating to waiver of compliance with certain education expenditure provisions, with an emergency clause.
Section A. Chapter 165, RSMo, is amended by adding thereto one new section, to be known as section 165.018, to read as follows:
165.018. 1. This section shall apply to any penalty that is or may be charged to any school district pursuant to section 165.016 for school year 2000-2001 or 2001-2002.
2. Any school district in this state that demonstrates to the department of elementary and secondary education that such district's failure to comply with the expenditure ratios set out in section 165.016 was either directly or indirectly caused by increases in utility rates during any such school year, provided that such increases were greater than twenty-five percent of such school district's utility costs in the prior school year, shall be entitled to a waiver of the penalty imposed pursuant to section 165.016 for any such school year.
3. The state board of education may promulgate rules for the enforcement of this section. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been promulgated pursuant to chapter 536, RSMo.
Section B. Because immediate action is necessary to avoid financial crises in the school districts of this state, section A of
this act is deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby
declared to be an emergency act within the meaning of the constitution, and section A of this act shall be in full force and
effect upon its passage and approval.
