AN ACT
To amend chapters 91, 393 and 394, RSMo, by adding thereto three new sections relating to the protection of certain citizens from termination of utility services.
Section A. Chapters 91, 393 and 394, RSMo, are amended by adding thereto three new sections, to be known as sections 91.029, 393.370 and 394.330, to read as follows:
91.029. 1. No municipally owned utility shall terminate the utility service of any persons with disabilities, veterans of any branch of the United States Armed Forces, persons over the age of sixty-five years or persons or households with incomes below the poverty level as determined by the federal government of the United States, between the dates of the fifteenth of November of any year and the first of April of the subsequent year.
2. Notwithstanding any other provision of law to the contrary, the public service commission shall have the authority to make rules for the enforcement of this section upon municipally owned utilities. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been promulgated pursuant to chapter 536, RSMo.
393.370. 1. No gas, electric, water, heating or sewer corporation shall terminate the utility service of any persons with disabilities, veterans of any branch of the United States Armed Forces, persons over the age of sixty-five years or persons or households with incomes below the poverty level as determined by the federal government of the United States, between the dates of the fifteenth of November of any year and the first of April of the subsequent year.
2. The commission shall have the authority to make rules for the enforcement of this section. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been promulgated pursuant to chapter 536, RSMo.
394.330. 1. No cooperative formed pursuant to this chapter shall terminate the utility service of any persons with disabilities, veterans of any branch of the United States Armed Forces, persons over the age of sixty-five years or persons or households with incomes below the poverty level as determined by the federal government of the United States, between the dates of the fifteenth of November of any year and the first of April of the subsequent year.
2. Notwithstanding any other provision of law to the contrary, the public service commission shall have the

rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been
promulgated pursuant to chapter 536, RSMo.
