AN ACT
To amend chapter 247, RSMo, by adding thereto one new section relating to water purchases and sales involving rural water supply districts.
Section A. Chapter 247, RSMo, is amended by adding thereto one new section, to be known as section 247.226, to read as follows:
247.226. 1. For purposes of this section, a "rural water supply district" shall mean any public water supply district in this state that:
(1) Has received, or is entitled to receive, rural water and sewer grants and loans pursuant to sections 644.568 and 644.574, RSMo; or
(2) Is otherwise designated by the clean water commission as serving small rural communities pursuant to section 644.117, RSMo.
2. Rural water supply districts, in any transaction wherein such district is either purchasing water from, or selling water to, any water corporation regulated pursuant to chapters 386 and 393, RSMo, shall be granted preference by the public service commission. It shall be the policy of the public service commission in such cases to state that transactions which benefit rural water supply districts are in the public interest of this state.
3. The clean water commission, the safe drinking water commission, the public service commission and any other commission or agency of this state, shall enforce any policy dealing with the development and maintenance of water supply in this state in a manner which favors the further development of rural water supply districts in areas where such development will aid in removing individuals from reliance on well-drawn water and placing such individuals under the service of a rural water supply district.
4. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has
been promulgated pursuant to chapter 536, RSMo.
