AN ACT

To amend chapter 196, RSMo, by adding thereto one new section relating to the tobacco settlement.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 196, RSMo, is amended by adding thereto one new section, to be known as section 196.1035, to read as follows:

196.1035. 1. A portion of any tobacco settlement moneys received by the state of Missouri shall be used to fund a grant program, administered by the division of aging, to increase the availability of ventilators in long-term care facilities. Such program shall provide grants to qualifying long-term care facilities for the purchase of ventilators. Such grants may include the maintenance, supplies and personnel training costs associated with the use of ventilators in long-term care facilities.

2. The division of aging shall promulgate rules to implement the provisions of this section. No rule or portion of a rule promulgated pursuant to the authority of this section shall become effective unless it has been promulgated pursuant to chapter 536, RSMo.
