HB 1309 -- Nursing Homes

Co-Sponsors:  Boucher, Hollingsworth, Selby, Hosmer

This bill requires the Department of Health and Senior Services
to issue a news release about any notice of noncompliance issued
to a nursing home, including specific violations, the date of the
violation, the facility where the violation occurred, and a
listing of other facilities owned, administered, or managed by
the same provider.  The news release must be issued within 30
days of substantiation of noncompliance to all radio and
television stations in Missouri and to all newspapers in the
state with a minimum circulation of 10,000.  Media outlets that
provide public notice of noncompliance are immune from civil or
criminal liability.  The bill also requires notice of
noncompliance of nursing homes to be shared with nursing home
advocacy agencies listed with the Division of Aging.  Notices of
noncompliance pursuant to Section 198.029, RSMo, must be included
on the Family Care Safety Registry as of January 1, 2003.
