Summary of the Introduced Bill

HB 1998 -- Adult Establishments

This bill regulates adult establishments.  The bill:

(1)  Prohibits minors from loitering in adult establishments,
including parking lots;

(2)  Requires all adult establishments to be well lit and
continuously and physically arranged to make the interior clearly
visible from the common areas.  Enclosed booths, cubicles, rooms,
or stalls with doors or curtains for private viewing purposes are
prohibited within adult establishments.  In addition, any area
used for viewing sexual materials or performances must be well
lit, readily accessible, and open to view at all times;

(3)  Prohibits the placement of a hole in a wall constructed to
aid sexual conduct between persons on either side of the wall or
partition;

(4)  Makes the operator vicariously liable for the acts or
omissions of an employee who violates the provisions of the bill;

(5)  Makes all adult establishments open to inspection at
reasonable times;

(6)  Allows injunctions to abate violations of the bill by the
Attorney General or a county or municipal prosecutor; and

(7)  Makes violators of the bill guilty of a class A misdemeanor
for the first offense and a class D felony for a second or
subsequent offense.
