HB 2206 -- Rental Increases

Sponsor:  Fraser

This bill requires all residential property leases entered into
after August 28, 2002, to require lessors:

(1)  to provide lessees with 90 days notice of any proposed
rental increases that exceed the average monthly rent for the
preceding 12 months by more than 5%.  If the notice is not given,
the monthly rent will remain the average of the monthly rent
immediately preceding the proposed rental increase; and

(2)  to provide lessees with 180 days notice of any proposed sale
or change in the nature of the property where the lessee resides.
If the required notice is not given, the lessor must pay an
amount equal to six months rent to the lessee.

If the required notices are not given, the lessor is subject to a
fine of up to $5,000 per violation.  Fines are paid to the State
School Fund.
