AN ACT
To amend chapter 144, RSMo, by adding thereto one new section relating to sales tax for highways and bridges, with a referendum clause.
Section A. Chapter 144, RSMo, is amended by adding thereto one new section, to be known as section 144.024, to read as follows:
144.024. 1. In addition to the tax levied and imposed pursuant to subdivisions (1) to (8) of subsection 1 of section 144.020, an additional tax of one percent is hereby levied and imposed upon all sellers for the privilege of engaging in the business of selling tangible personal property or rendering taxable service at retail in this state. The revenue derived from the one percent rate imposed pursuant to this section shall be deposited in the state road fund and used exclusively for highway and bridge construction and maintenance, and shall be distributed as follows: fifty percent to urban areas, and fifty percent to rural areas, except that any moneys used for construction or maintenance of the interstate system, as defined in section 226.510, RSMo, shall not be subject to the distribution percentages in this section.
2. The distribution and use of any moneys pursuant to this section shall be subject to legislative review or oversight by the members of each house in the second regular session of each general assembly. In the event that the general assembly finds that such moneys are not distributed or used pursuant to this section, the legislature shall have the power, by a two-thirds vote of all members elected to each house, to withhold the distribution of such moneys.
Section B. Section A of this act is hereby submitted to the qualified voters of this state for approval or rejection at an
election which is hereby ordered and which shall be held and conducted on the Tuesday immediately following the first
Monday in November, 2002, or at a special election to be called by the governor for that purpose, pursuant to the laws and
constitutional provisions of this state applicable to general elections and the submission of referendum measures by
initiative petition, and it shall become effective when approved by a majority of the votes cast thereon at such election and
not otherwise.
