AN ACT
To amend chapter 86, RSMo, by adding thereto one new section relating to peace officer's health impairment.
Section A. Chapter 86, RSMo, is amended by adding thereto one new section, to be known as section 86.071, to read as follows:
86.071. 1. As used in this section the term "peace officer" means any person who is regularly employed by an employing law enforcement agency and licensed pursuant to chapter 590, RSMo, who possesses the duty and power of arrest for violation of the criminal laws of this state or for violation of orders or ordinances of this state or any political subdivision of this state.
2. Notwithstanding the provisions of any law to the contrary, after five years' service, any condition of impairment
of health caused by any disease of the lungs or respiratory tract, hypertension, or disease of the heart resulting in
total or partial disability or death to a peace officer, who successfully passed a physical examination within five
years prior to the time a claim is made for such disability or death, which examination failed to reveal any evidence
of such condition, shall be presumed to have been suffered in the line of duty, unless the contrary be shown by
competent evidence.
