AN ACT
To amend chapter 304, RSMo, by adding thereto one new section relating to the transportation of hazardous materials through highway tunnels, with penalty provisions.
Section A. Chapter 304, RSMo, is amended by adding thereto one new section, to be known as section 304.370, to read as follows:
304.370. 1. For the purpose of this section, hazardous materials shall be defined pursuant to Part 397, Title 49, Code of Federal Regulations, as adopted and amended.
2. No person shall transport hazardous materials in or through any highway tunnel in this state.
3. No person shall park a vehicle containing hazardous materials within three hundred feet of any highway tunnel in this state except as provided pursuant to Part 397, Title 49, Code of Federal Regulations, as such regulations have been and may periodically be amended.
4. Any person who is found guilty or pleads guilty to a violation of this section shall be guilty of a class B
misdemeanor. Any person who is found guilty or pleads guilty to a second or subsequent violation of this section
shall be guilty of a class A misdemeanor. Violations of this section shall be enforced pursuant to section 390.201,
RSMo.
