AN ACT

To amend chapter 630, RSMo, by adding thereto one new section relating to an equitable distribution system for local effort moneys and annual state appropriations for outpatient mental health services.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 630, RSMo, is amended by adding thereto one new section, to be known as section 630.097, to read as follows:

630.097. 1. Beginning July 1, 2007, the department of mental health shall implement an equitable distribution system of local effort moneys and state appropriations designated for distribution to political subdivisions of the state for evaluation, care, treatment, and rehabilitation services provided on an outpatient basis to persons affected by mental disorders and mental illness. Such equitable distribution system shall include, but not be limited to:

(1) By January 1, 2006, designation of uniform service areas for the state for all three categories of outpatient mental health services: alcohol and drug abuse, comprehensive psychiatric services, and mental retardation and developmental disabilities;

(2) By January 1, 2006, development of a standard plan by the department for the service areas designated in subdivision (1) of this subsection to provide local providers and each service area with guidelines for providing outpatient mental health services and receiving state funding;

(3) By January 1, 2006, promulgation of rules by the department to establish the criteria for the allocation and distribution of the local effort moneys and state appropriations pursuant to this section; and

(4) Education of and interaction with political subdivisions within each service area on ways to maximize the efficiency and effectiveness of the services provided and the funding for such services in the service area.

2. By July 1, 2007, each political subdivision of the state receiving state funding for the provision of services set forth in subsection 1 of this section shall report to the department of mental health the total dollar amount of local effort that will be contributed by the political subdivision for the provision of the services set forth in subsection 1 of this section. Political subdivisions may collaborate and pool their local efforts to increase the overall funding of the designated service area and better serve the needs of persons receiving services.

3. The department of mental health shall by rule establish the specific measurable criteria used by the department to equitably distribute the local effort moneys and the annual state appropriations designated for the services set forth in subsection 1 of this section. Such criteria shall be based on the following:

(1) One-half of the local effort moneys and annual state appropriations shall be distributed proportionally to each political subdivision receiving such funding based on the criteria established by rule of the department, including but not limited to the population of the service area and the political subdivision's total dollar amount of local effort reported pursuant to subsection 3 of this section; and

(2) The remaining one-half of such local effort and annual state appropriations shall be distributed equitably by the department of mental health based on the following criteria:

(a) The population of the designated service area;

(b) The number of persons served in the designated service area;

(c) The amount of total local effort contributed by the political subdivision in relation to the need in the designated service area;

(d) The ability and efforts of the political subdivision to generate sufficient local effort to meet the needs of the designated service area;

(e) The types of services available in the designated service area and the cost of such services;

(f) The efficiency and effectiveness of the services contracted for and provided in the designated service area; and

(g) Any other relevant factors as determined by the department of mental health.

4. No rule or portion of a rule promulgated under the authority of this section shall become effective unless it has been promulgated pursuant to chapter 536, RSMo.
