AN ACT

To amend chapter 170, RSMo, by adding thereto one new section relating to foreign language instruction in elementary schools, with an effective date.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 170, RSMo, is amended by adding thereto one new section, to be known as section 170.027, to read as follows:

170.027. 1. Every child at a public elementary school in this state shall receive regular classroom instruction in a foreign language on a schedule determined to be developmentally appropriate by rule by the state board of education and subject to the availability of properly certified personnel. The state board of education shall set forth minimum standards for such instruction, which shall be implemented and may be exceeded by the local school boards of this state.

2. This section shall not apply to students:

(1) In any special school district who utilize the services of the district in an individualized education plan;

(2) Who have a learning or reading disability which may require special instruction. Such students may receive such special instruction in lieu of foreign language classes;

(3) For whom English is a second language. Such students may receive special English instruction, if necessary, in lieu of foreign language classes; or

(4) Who should otherwise be exempt from such instruction, as the state board of education may by rule determine.

3. The state board of education shall make such rules as are necessary for the enforcement of this section. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been promulgated pursuant to chapter 536, RSMo.

Section B. Section A of this act shall become effective July 1, 2003.
