Summary of the Committee Version of the Bill

HCS HB 213 -- ADVERSE POSSESSION

SPONSOR:  Byrd

COMMITTEE ACTION:  Voted "do pass" by the Committee on Judiciary
by a vote of 18 to 0.

This substitute creates a rebuttable presumption of notorious
possession for any tax year in which the adverse possession
claimant has proof of payment of the property tax due on the
subject property.

FISCAL NOTE:  Not available at time of printing.

PROPONENTS:  Supporters say that the bill would limit the filing
of frivolous claims for adverse possession.

Testifying for the bill was Representative Myers.

OPPONENTS:  Those who oppose the bill say that it would cause
havoc in the property title chains in urban areas.

Testifying against the bill was Missouri Land Title Association.
