AN ACT

To amend chapter 21, RSMo, by adding thereto one new section relating to intent statements for certain proposed legislative measures.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 21, RSMo, is amended by adding thereto one new section, to be known as section 21.321, to read as follows:

            21.321. 1. Any proposed legislative measure introduced for consideration during a regular or extraordinary session of the general assembly that contains authorization for the promulgation of administrative rules may include a statement of legislative intent. Upon passage and approval of such legislative measure, any administrative rules promulgated pursuant to the authority of a legislative measure including a statement of legislative intent shall not exceed the scope of such statement.

            2. The joint committee on administrative rules shall, upon request or at the committee's discretion, review an administrative rule subject to a statement of legislative intent and determine whether the promulgated rule is within the scope of the statement of legislative intent. If the committee determines that the administrative rule in question exceeds the scope of the statement of legislative intent, the rule shall be null and void.
