JOINT RESOLUTION

Submitting to the qualified voters of Missouri an amendment repealing section 3(b) of article IX of the Constitution of Missouri, and adopting one new section in lieu thereof relating to the public school fund.





Be it resolved by the House of Representatives, the Senate concurring therein:


            That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2004, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article IX of the Constitution of the state of Missouri:

            Section A. Section 3(b), article IX, Constitution of Missouri, is repealed and one new section adopted in lieu thereof, to be known as section 3(b), to read as follows:

            Section 3(b). In event the public school fund provided and set apart by law for the support of free public schools, shall be insufficient to sustain free schools at least eight months in every year in each school district of the state, the general assembly may provide for such deficiency; but in no case shall there be set apart less than [twenty-five] thirty-five percent of the state revenue, exclusive of interest and sinking fund, to be applied annually to the support of the free public schools.
