Summary of the Committee Version of the Bill

HJR 45, HCA 1, 2 -- TRANSPORTATION REVENUES

SPONSOR:  Yates

COMMITTEE ACTION:  Voted "do pass" by the Committee on
Transportation and Motor Vehicles by a vote of 18 to 2.

This proposed constitutional amendment requires that after the
first fiscal year following adoption of this provision the amount
of state revenue derived from highway users which is appropriated
to state offices and departments, except the State Highway
Patrol, will be reduced to zero.

The Department of Highways and Transportation and the Office of
Administration will be required to determine all new state
revenue derived from highway users as a result of legislative or
voter-approved measures taken after January 1, 2005, and all
projects funded from the new revenue.  The Commissioner of the
Office of Administration will be required to review all these
projects and determine if more than 80% of any project has been
completed within five years of the project's initial approval and
report the findings to the General Assembly and the Director of
the Department of Revenue.  If less than 80% of the project is
completed, collection of the new revenue attributable to the
project will cease to be collected within 60 calendar days of
notification.

HCA 1 -- Puts a 5-year phase in on the withdrawal of highway user
revenue appropriated to state offices and departments.

HCA 2 -- Removes the provision that if 80% of all projects funded
by new state revenue created after passage of the bill are not
completed within five years of the project's initial approval,
new state revenue attributable to the project will cease to be
collected.

FISCAL NOTE:  Not available at time of printing.

PROPONENTS:  Supporters say the amendment will help stop the
diversion of highway funds for non-highway use and be a great
step in restoring the public's confidence.

Testifying for the bill were Representative Yates; and Missouri
Chamber of Commerce.

OPPONENTS:  There was no opposition voiced to the committee.
