Summary of the Introduced Bill

HB 1153 -- Drug Crimes

This bill increases the penalties for some drug crimes when the
offense takes place within close proximity to, or within easy
access of, a child age 16 or younger.  The bill:

(1)  Makes it a class B felony to possess a controlled substance
near a child.  Under current law, possession of a controlled
substance is a class C felony.  However, if the controlled
substance is less than 35 grams of marijuana, it is currently a
class A misdemeanor; and the bill makes it a class D felony if
the marijuana is near a child;

(2)  Makes it a class B felony to possess more than 24 grams of
ephedrine with the intent to manufacture amphetamine and do so
near a child.  Under current law, the possession of these drugs
is a class D felony; and

(3)  Makes it is a class B felony to possess chemicals that are
precursor ingredients of methamphetamine when the chemicals are
near a child.  Possession of these chemicals is currently a class
C felony.
