HB 1251 -- Driving While Intoxicated

Sponsor:  Jolly

This bill increases the maximum penalty for a third
intoxication-related offense to five years' imprisonment.  Under
current law, a third intoxication-related offense within a
10-year period is a class D felony, which carries a maximum
penalty of four years.  The bill also amends the definition of
"persistent offender" to include any person with a felony
conviction for an intoxication-related offense who receives a
subsequent conviction for another intoxication-related offense.
