HB 1391 -- Escape from Detention

This bill expands the crimes of escape from commitment and escape
from custody. Escape from commitment, a class D felony, is
amended to include an escape by a person who has been civilly
committed as a sexually violent predator. The offense includes
an escape made while the person is being detained in a secure
facility for evaluation prior to commitment.
The bill also makes the crime of escape from custody a class D
felony when the person had been ordered by a court to be taken
into custody at a secure facility for the purpose of determining
whether the person should be civilly committed as a sexually
violent predator. Under current law, escape from custody is a
class A misdemeanor, unless the person was arrested for a felony,
in which case the escape is a class D felony.
