AN ACT
To amend chapter 610, RSMo, relating to governmental bodies and records by adding thereto one new section relating to traffic violation records.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 610, RSMo, is amended by adding thereto one new section, to be known as section 610.160, to read as follows:
610.160. 1. A person who has pleaded guilty or has been convicted of a misdemeanor for either a first offense of violating a provision of chapter 304, RSMo, or a first offense of violating a county or city traffic ordinance not related to driving while intoxicated and who since such date has not been convicted of any other traffic related driving offense may apply to the court in which the person pled guilty or was sentenced, for an order to partially seal all official records and all records of the person's arrest, plea, trial or conviction.
2. Such application procedure shall be simple enough to eliminate the need for counsel.
3. If the court determines, after a hearing, that such person has not been convicted of any traffic related driving offenses since the date of conviction, then the court shall enter an order to partially seal all official records of the person related to the conviction.
4. The effect of such order shall be to deny access of all official records regarding the person's conviction to any employer or prospective employer beginning on a date one year after the person's conviction and to deny access of all official records on the person to any insurer or prospective insurer beginning on a date two years after the person's conviction.
5. A person shall only be entitled to one order to partially seal official records pursuant to this section.
