AN ACT
To amend chapter 488, RSMo, by adding thereto one new section relating to court costs in criminal cases.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 488, RSMo, is amended by adding thereto one new section, to be known as section 488.5333, to read as follows:
488.5333. In all criminal cases including violations of any county ordinance or any violation of criminal or traffic laws of this state, including an infraction, there shall be assessed as costs a surcharge in the amount of two dollars. No such surcharge shall be collected in any proceeding involving a violation of an ordinance or state law when the proceeding or defendant has been dismissed by the court or when costs are to be paid by the state, county or municipality. Such surcharge shall be collected and disbursed by the clerk of the court as provided by sections 488.010 to 488.020. Moneys collected from this surcharge shall be payable to the sheriff of the county where the violation occurred to offset expenses for housing prisoners in the county jail.
