HCS HB 924 -- LIABILITY FOR SCHOOL EMPLOYEES AND VOLUNTEERS SPONSOR: Wallace COMMITTEE ACTION: Voted "do pass" by the Special Committee on General Laws by a vote of 8 to 0. This substitute expands the existing liability protection for teachers and other personnel from matters of school discipline to include other issues handled in conformity with the established policies of the school board. Employees who are not qualified to administer medication are not subject to disciplinary action for refusing to administer it. Qualified or trained employees are exempted from liability for administering medication in good faith and according to standard medical practice, as well as administering cardiopulmonary resuscitation or other lifesaving measures in good faith. FISCAL NOTE: No impact on state funds in FY 2006, FY 2007, and FY 2008. PROPONENTS: Supporters say that school personnel frequently encounter medical situations, and the bill clarifies their position. School personnel following school board policies in any situation should not be held liable.
