AN ACT

To amend chapter 197, RSMo, by adding thereto one new section relating to financial interests of hospitals.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 197, RSMo, is amended by adding thereto one new section, to be known as section 197.125, to read as follows:

            197.125. 1. No hospital licensed in this state, parent company of such hospital, or affiliate of such hospital shall own, or have any ownership or other financial interests in any health carrier, as defined in section 376.1350, RSMo.

            2. Any hospital, parent company, or affiliate that owns, or has any ownership or other financial interests in a health carrier on the effective date of this section shall divest of such interests by January 1, 2007.

            3. Failure to comply with the provisions of this section by a hospital, its parent company, or its affiliate shall make the hospital subject to licensure suspension or revocation.
