AN ACT
To amend chapter 197, RSMo, by adding thereto one new section relating to hospital services for correctional and detention facilities.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 197, RSMo, is amended by adding thereto one new section, to be known as section 197.175, to read as follows:
197.175. 1. No hospital licensed in the state of Missouri that receives funding from the state Medicaid program shall refuse to contract with or provide services to the department of corrections directly or any contractor with the department of corrections who provides medical services to any individual incarcerated in a Missouri correctional setting.
2. Effective September 1, 2005, the department or its contracted medical provider shall pay to a provider of a medical service for an individual incarcerated in a correctional or detention facility an amount no less than one hundred percent of the state Medicaid reimbursement rate for any given procedure applicable to such provider and service. Such limitation applies to all medical care services, both inpatient and outpatient, goods, prescription drugs, and medications provided to a person outside the facility.
3. At the request of the department of corrections, the attorney general shall seek injunctive relief from a court of competent jurisdiction or the circuit court of Cole County against any hospital that does not comply with the provisions of this section. If a court finds in favor of the state, attorney's fees shall be awarded to the state.
