AN ACT
To amend chapter 285, RSMo, by adding thereto one new section relating to financial incentives for employers.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 285, RSMo, is amended by adding thereto one new section, to be known as section 285.150, to read as follows:
285.150. 1. Any employer in the state of Missouri that employs more than five hundred employees, including employees under the workforce development program, shall be ineligible to receive any state moneys, state aid, state assistance, state tax credits, or other financial incentives from the state of Missouri if more than twenty-five percent of the employer's employees are receiving compensation from the employer in an amount less than one hundred percent of the federal poverty level.
2. Any state department or agency that determines eligibility for the receipt of state moneys, state aid, state assistance, state tax credits, or other financial incentives offered by the state of Missouri shall verify that any employer described in subsection 1 of this section is in compliance with the provisions of subsection 1 of this section in order to maintain eligibility to receive such state moneys, state aid, state assistance, state tax credits, or other financial incentives offered by the state of Missouri.
3. Any state department or agency described in subsection 2 of this section may promulgate rules to implement the provisions of this section. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2005, shall be invalid and void.
